Nova is built to use as little data as possible. Nova does not require an account, login, email address, name, home address, or any other registration information.

Nova is intended for children under 13, with parental involvement. Certain parent settings are protected by a parental gate and a parent-selected PIN.

Nova is designed so that it does not collect or store personal data on our servers.

[04]Microphone access

Nova may request access to the device microphone solely to support certain game interactions, such as detecting whether reading aloud or music-making is happening.

If microphone access is denied, parts of the gameplay experience may be limited.

[05]Family Controls / social media usage

Nova may use Apple parental control features (Family Controls / Screen Time API) and related device permissions to support gameplay connected to social media reduction.

If a parent chooses to enable this feature:

• the parent selects which social media apps are relevant;
• Nova uses that information only locally on the device to influence the in-game condition of Nova, the alien character;
• the purpose is to support the game experience and encourage healthier habits.

Nova uses limited device-based signals only to operate the game as intended.

• making certain in-game activities work;
• influencing Nova's in-game wellbeing;
• encouraging playful alternatives such as reading and music-making;
• enabling parents to set up and protect parental settings.

Where any permission-based device information is used, it is used only for gameplay functionality and not for commercial profiling or tracking.

[07]Legal basis for processing

To the extent privacy laws such as the GDPR apply, Nova relies on the following bases where relevant:

• Performance of a contract or provision of the requested app functionality, where limited technical processing is necessary for the game to function;
• Consent, where device permissions are requested, such as microphone access or parental-control-related permissions;
• Legitimate interests, only where strictly necessary to maintain the security, integrity, and functionality of the app, and only in a minimal, privacy-preserving way.

Because Nova is designed not to collect or store personal data on our servers, many traditional data-processing activities do not occur in Nova at all.

[08]Data storage and retention

Nova is designed so that personal data is not stored by us.

• We do not keep account records because there are no accounts.
• We do not keep microphone recordings because no recordings are made.
• We do not keep social media usage logs on our servers.
• We do not maintain a cloud profile for users.

All gameplay state is stored locally on the device using iOS on-device storage. If the app is deleted from the device, any local gameplay state may also be removed, subject to the way iOS handles app deletion.

Nova does not use third-party analytics, advertising SDKs, or external databases.

Nova does not sell personal information and does not share personal information with advertisers or data brokers.

Nova is distributed through the Apple App Store. Apple's own privacy practices are governed by Apple's privacy policy.

Nova is made available worldwide through the Apple App Store. Even though the app may be downloaded in multiple countries, Nova is designed to minimize data handling by not collecting or storing personal data on our servers.

Nova is designed to comply with the U.S. Children's Online Privacy Protection Act (COPPA) and similar international children's privacy laws by not collecting personal information from children. Because Nova does not collect, use, or disclose personal information, verifiable parental consent for data collection is not required.

Nova is intended to be used with parental involvement and includes a parental gate for parent settings.

Nova is designed to minimize children's data exposure by:

• not requiring accounts;
• not collecting registration details;
• not recording or storing microphone audio;
• not using advertising or analytics SDKs;

Because Nova does not maintain user accounts or store personal data on our servers, there is generally little or no server-side personal data for us to access, correct, export, or delete.

Nova is a digital game in which the player cares for a virtual alien character named Nova. The game is designed to encourage reduced social media use and to promote alternative activities such as reading aloud, music-making, and playful care routines.

Nova is entertainment software. It is not therapy, medical treatment, counseling, or a guaranteed behavior-change solution.

[02]Eligibility and parental involvement

Nova is intended for children under 13 with parental involvement.

Nova is offered as a one-time paid app purchase through the Apple App Store for the price shown at the time of purchase.

Subject to these Terms and any applicable App Store rules, Negoci grants you a limited, non-exclusive, non-transferable, revocable license to use Nova for personal, non-commercial use on compatible Apple devices.

You do not acquire ownership of the app, its software, or its intellectual property.

Except where mandatory law provides otherwise, purchases are final.

Negoci does not provide refunds directly. Purchases made through the Apple App Store are subject to Apple's payment and refund systems and policies.

Nova does not require an account or login. Access to the app depends on your valid App Store purchase and device compatibility.

[06]Device permissions

Certain features of Nova may request device permissions, including microphone access and parental-control-related permissions.

You may choose not to grant these permissions, but parts of the app may then be limited or unavailable.

• reverse engineer, decompile, or attempt to extract source code, except where mandatory law expressly permits it;

Nova may include an optional feature that allows a parent to connect selected social media usage patterns to gameplay effects.

That feature:

• is optional;
• is controlled by a parent;
• is meant only to influence gameplay;
• is not a guarantee that a child will reduce social media use;
• does not replace parental judgment, device settings, or professional guidance.

Negoci is not responsible for parenting outcomes, screen-time outcomes, or any decisions made by users or families based on the gameplay.

Nova may use microphone access only to support gameplay interactions such as detecting whether reading aloud or music-making is taking place.

Nova does not promise that microphone-based features will always function perfectly, accurately, or without interruption on every device or in every environment.

Nova is a game. It does not provide medical advice, mental health treatment, psychological diagnosis, educational assessment, or professional care.

Any statements about healthier habits, reduced social media use, or encouraging reading or music are general product aims only. No result is promised or guaranteed.

If you have concerns about a child's health, development, wellbeing, or problematic media use, consult an appropriate qualified professional.

[11]Disclaimer of warranties

To the maximum extent permitted by law, Nova is provided "as is" and "as available."

Negoci disclaims all warranties, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not guarantee that Nova will:

• be uninterrupted;
• be error-free;
• always work on every device;
• meet every user's expectations;
• produce any specific behavioral or developmental outcome.

[12]Limitation of liability

To the maximum extent permitted by law, Negoci shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including loss of data, loss of goodwill, device issues, interrupted use, or other intangible losses arising from or related to Nova.

To the maximum extent permitted by law, Negoci's total liability for any claim relating to Nova shall not exceed the amount paid for the app.

Nothing in these Terms excludes liability that cannot be excluded under applicable law.

[13]Suspension and termination

Because Nova does not use accounts, access generally depends on the continued availability of the app on your device and through the App Store ecosystem.

We may update, modify, suspend, or discontinue Nova or parts of it at any time, to the extent permitted by law.

You may stop using Nova at any time by deleting the app from your device.

[14]Intellectual property

All rights, title, and interest in and to Nova, including its software, design, text, graphics, characters, branding, and related materials, remain the property of Negoci or its licensors.

You may not use Nova's trademarks, name, branding, or assets without prior written permission.

[15]App Store terms

If you download Nova through Apple's App Store, you also acknowledge that:

• these Terms are between you and Negoci, not Apple;
• Apple is not responsible for Nova or its content;
• your use of Nova must comply with applicable App Store terms.

[16]Privacy

Your use of Nova is also governed by the Nova Privacy Policy.

[17]Governing law

These Terms are governed by the laws of The Netherlands, excluding conflict-of-law rules.

Any dispute arising out of or in connection with these Terms shall be submitted to the competent court in The Netherlands, unless mandatory consumer law provides otherwise.
